On November 22, 2023, the Michigan Supreme Court issued an important Order in Dezman v Charter Twp of Bloomfield (Case No. 165875) that clarified when uses are generally allowed under the “permitted uses” section of a municipal zoning ordinance in Michigan. Depending upon the wording of the particular ordinance, if the use is not expressly listed in the permitted use section of the zoning district involved, it is normally not allowed in that zoning district. In other words, uses not specifically listed are generally disallowed. This decision could have a significant impact upon whether a variety of different uses, including, but not limited to, short-term rentals, the keeping of farm animals and home occupation uses are permitted uses allowed in a particular zoning district if not mentioned.
