The Michigan Court of Appeals released its published opinion in the case of In re Estate of Virgil F. Hoppert, ______ Mich App ____ (2023) regarding rights of first refusal and first options in real estate matters in Michigan. This decision clarifies when such options are valid and do not constitute an unreasonable restraint on alienation (i.e. the ability to sell or transfer real property).
