Governor Whitmer has issued multiple executive orders the past couple of weeks regarding Michigan Stay Home – Stay Safe and MI Safe Start: A Plan to Re-engage Michigan’s Economy.
The temporary extension of the Freedom of Information Act deadlines expires on June 11, 2020, and the current executive order specifically authorizing remote public meetings is set to expire on June 30, 2020. Unfortunately, the Governor’s executive orders regarding in person municipal meetings are unclear. Should municipalities choose to conduct in-person public meetings, they should be cognizant of the restrictions listed below regarding indoor gatherings and should consult with their municipal attorneys.
Currently, the executive orders have the following general effects:

- Individuals are no longer required to stay at home; however, when leaving their homes, individuals must adhere to certain social distancing and face covering requirements.
- Work (including office work) that can be performed remotely should still be performed remotely.
- Outdoor parks and recreational facilities may open subject to certain modifications and social distancing requirements.
- Retailers may open subject to capacity and social distancing requirements.
- Outdoor swimming pools may open subject to capacity and social distancing requirements.
- Libraries and museums may open subject to capacity and social distancing requirements.
- Vacation rentals are permitted.
- Industry specific workplace capacity, social distancing, screening, and other related requirements have been imposed.
For Regions 1, 2, 3, 4, 5, and 7:
- Still subject to social distancing requirements, the number of people permitted at an indoor gathering may not exceed 10.
- Still subject to social distancing requirements, the number of people permitted at an outdoor gathering may not exceed 100.
- Restaurants and bars may open subject to capacity and social distancing requirements.
- Beginning June 15, 2020, hair salons, and other non-essential personal care business may open subject to capacity and social distancing restrictions.
For Regions 6 and 8:
- Restaurants and bars may open subject to capacity and social distancing requirements.
- Beginning June 10, 2020 and subject to social distancing requirements, the number of people permitted at an indoor gathering is increased from 10 to 50.
- Beginning June 10, 2020 and subject to social distancing requirements, the number of people permitted at an outdoor gathering is increased from 100 to 250.
- Beginning June 10, 2020, event venues, including movie theaters, may open subject to capacity and social distancing requirements.
- Beginning June 10, 2020, gyms, hair salons, and other non-essential personal care business may open subject to capacity and social distancing restrictions.
- Beginning June 10, 2020, indoor swimming pools may open subject to capacity and social distancing requirements.
