On April 9, 2020 at 2:07 pm, Governor Whitmer issued Executive Order 2020-42 (the “EO”). The EO was effective April 9, 2020 at 11:59 pm and continues until April 30, 2020 at 11:59 pm. In addition to extending the duration of the Stay – at – Home order previously issued under Executive Order 2020-21, the EO enacts additional travel restrictions (among other things).
The EO specifically addresses some of the concerns raised by Michigan municipalities experiencing an influx of vacationers and seasonal residents, and it restricts travel accordingly:
(b) Individuals may also travel:
- To return to a home or place of residence from outside this state.
- To leave this state for a home or residence elsewhere.
- Between two residences in this state, through April 10, 2020. After that date, travel between two residences is not permitted.
- As required by law enforcement or a court order, including the transportation of children pursuant to a custody agreement.
(c) All other travel is prohibited, including all travel to vacation rentals.

Municipalities seeking to enforce the EO’s travel restrictions or implement additional restrictions should consult with their municipal attorney.
